When the case came up for hearing today, Mr. O.T Are, representing the Applicant, told the court that the Motion on Notice has lost its relevance since the Applicant has been impeached and therefore applied to withdraw the Motion on Notice as it has been overtaken by event.

The lawyers to the defendants, Mr. Olusegun Olaotan who is the Solicitor General of Ogun State, who led Mr Adekunle Emmanuel, Assistant Director of Civil Litigation and Mr C O. Obi, Senior State Counsel for the Defendants/Respondents, did not oppose the application for withdrawal. The said Motion on Notice was therefore struck out.

Counsel to the Applicant informed the court that he has just been served a Notice of Preliminary Objection by the Defendants/Respondents and would therefore need a date to respond to same.

The case was therefore adjourned till October 27, 2023 for hearing of the Originating Summons dated 6th September, 2023. The court also urged Counsel for both parties to be prepared to address the Court whether the proceedings has not become a mere academic exercise by the fact that the Litigant/Applicant has been impeached.
